Tripperist — Terms of Use

1. Acceptance

By downloading or using Tripperist (“the App”), you agree to these Terms. If you do not agree, do not use the App.

2. Nature of the Service

Tripperist is a personal, non-commercial hobby project provided free of charge by a private individual. It is not operated by a company, LLC, or other legal entity. The App is offered on a best-effort basis with no guarantees of uptime, accuracy, or continued availability.

3. What the App Does

Tripperist is a road-trip planning app that lets you discover historical markers and points of interest, save favorites, and build trip itineraries. Map tiles are provided by OpenStreetMap contributors under the Open Database License. Historical marker data is sourced from the Historical Marker Database (HMDB.org). Location data shown in the App may be inaccurate, incomplete, or out of date — always verify independently before relying on it.

4. Your Account

  • You must be 13 years or older to create an account.
  • You are responsible for keeping your credentials secure.
  • You may delete your account at any time from the Profile screen. Deletion is immediate and permanent — see our Privacy Policy for details.
  • We reserve the right to suspend or terminate accounts that violate these Terms, at any time, for any reason, without notice or liability.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or interfere with the App or its backend services.
  • Upload or transmit content that is harmful, infringing, or deceptive.
  • Use automated tools to access the API beyond normal app usage.

6. User Content

Any trip names, descriptions, or other content you create in the App belongs to you. By saving it to our servers, you grant us a limited license to store and sync that content solely to provide the service to you. We do not sell or share your content with third parties.

7. Third-Party Services

The App uses third-party services including:

  • Auth0 — for authentication. Subject to their terms at auth0.com.
  • OpenStreetMap — for map tiles. Subject to the OSM Tile Usage Policy.
  • HMDB.org — for historical marker data.

We have no control over and assume no responsibility for the availability, accuracy, conduct, or terms of these services.

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED SERVICE.

WE MAKE NO WARRANTY THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL BE ERROR-FREE OR FREE OF VIRUSES; (C) ANY INFORMATION PROVIDED IS ACCURATE, CURRENT, OR COMPLETE.

USE THE APP AT YOUR OWN RISK. NAVIGATION AND LOCATION FEATURES ARE AIDS ONLY — THEY DO NOT REPLACE SAFE DRIVING JUDGMENT. YOU ARE SOLELY RESPONSIBLE FOR COMPLYING WITH ALL TRAFFIC LAWS, ROAD CONDITIONS, AND LOCAL REGULATIONS. DO NOT USE THE APP WHILE OPERATING A VEHICLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, PERSONAL INJURY, PROPERTY DAMAGE, OR ANY OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  • OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED $10 USD.

  • SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless the developer of Tripperist from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content you submit through the App.

11. Dispute Resolution

Mandatory Pre-Litigation Resolution Period. Before filing any legal claim of any kind arising from or related to the App or these Terms, you agree to notify us in writing at tripperista@gmail.com describing the nature of your claim and the relief you seek. You further agree to negotiate in good faith for a period of 60 days from the date of that notice before initiating any legal proceeding. Any claim filed before this period expires shall be dismissed without prejudice. This requirement applies to all claims, including those for injunctive relief, except where prohibited by law.

Any dispute not resolved during the pre-litigation period shall be governed exclusively by the laws of the State of Nevada, with venue in the state or federal courts located in Nevada. You waive any objection to jurisdiction or venue in those courts.

12. Changes to the App and Terms

We may modify, suspend, or discontinue the App at any time without notice or liability. We may also update these Terms at any time. Continued use after changes are posted constitutes acceptance. Material changes will be noted with an updated effective date.

13. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
